Terms and Conditions of UnderCoverWear’s Online Clearance Orders
These terms and conditions apply only to online orders placed through the UnderCoverWear Clearance Webpages. All other orders, whether placed with an Independent Sales Consultant, over the phone to our Head Office, or online through our current range order form are subject to separate terms and conditions. Orders placed through UnderCoverWear’s Clearance Webpages can not be combined with online orders from UnderCoverWear’s current range. Orders, payments and shipments will all be kept separate.
In these terms and conditions “we” and “us” mean UnderCoverWear and “you” means you the customer. These terms and conditions together with your order constitute the entire contract between UnderCoverWear and you for the supply of products. No other terms and conditions will apply. The contract cannot be varied unless we agree to vary it in writing or by email.
While we have made every effort to display the colours of our products as accurately as possible, please note that the colours you see on screen highly depend on the type, brand and settings of your monitor. Please note that shades and colours of fabrics and laces may vary slightly due to dyeing and processing and the Company takes no responsibility for exact matching. It is essential that customers follow washing instructions to avoid damage to the garments.
Correction of Errors and Inaccuracies; Limitations on Quantity
Whilst UnderCoverWear makes every reasonable effort to present accurate information on this website, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability.
Legal Capacity to Transact
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If you are under the age eighteen (18) years you cannot place orders with UnderCoverWear. Should UnderCoverWear suffer any damage or other losses as a result of a transaction entered into by a minor, UnderCoverWear reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with UnderCoverWear.
All UnderCoverWear purchases include GST unless otherwise stated on the product listing.
Placing Your Order
You may place an order by adding items to the ‘Cart’ on UnderCoverWear’s Clearance Webpages and clicking the ‘Check Out’ button. By placing an order, you make an offer to us to purchase the products you have selected based on these terms and conditions. Information contained on the UnderCoverWear website constitutes an invitation to treat. We will notify you that your order is being processed by sending you an order confirmation via email, however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. UnderCoverWear and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion. If we cannot process or accept your order after payment is received we will contact you by email or telephone.
Payment for Your Order
All orders from the UnderCoverWear Clearance Webpages must be paid for by credit card. UnderCoverWear Gift Vouchers, Merchandise Certificates, Credit Slips, and other promotional vouchers issued by UnderCoverWear are not valid methods of payment towards orders made through the UnderCoverWear Clearance Webpages.
Cancellation of a Credit Card Transaction
If you would like to cancel a credit card transaction you must contact our Customer Service Team. If the order resulting from the transaction in question has not yet been fulfilled then we will cancel the order and reverse your credit card payment. If however the order has been fulfilled, you will need to wait to receive your order and then return it to us for a refund per the policy outlined above.
Delivery of Your Products
We only sell and ship products within Australia and New Zealand. We will not make deliveries outside of Australia or New Zealand. UnderCoverwear makes every effort to deliver your Clearance Website order via Australia Post, Australia Air Express or New Zealand Post. Unless otherwise agreed by us, we will deliver your products to the address indicated on your order confirmation. We will use all reasonable efforts to despatch your order to you within 7 business days from the date of order confirmation, stock availability permitting. Delivery time frames will then vary dependant on Australia Post, Australia Air Express or New Zealand Post.
Your Rights to Return a Product
No exchanges or refunds are accepted on items purchased through the UnderCoverWear Clearance Webpages unless the garment is faulty or ‘unfit for the purpose’. In the event your garment is faulty, you may return your garment for a full refund.
UnderCoverWear will refund only if the product is damaged or faulty on arrival. Refunds for damaged or faulty goods are only accepted within 30 days of the date of despatch shown on the delivery form. The item must be returned to us in original condition, with the packaging and item being exactly as it was when you received it and accompanied by the delivery form. This includes the return of the original packaging including labels and tags still being attached. UnderCoverWear will reserve the right to determine if the product is deemed damaged or faulty. The item must appear unworn or unused. If a manufacturing fault becomes apparent (fair wear and tear excepted) after the 30 days, you may return the garment and if after examination your complaint is found to be justified, you will be issued with a refund. For your security, returns should be sent by traceable delivery as we cannot accept responsibility for missing goods. We do not accept COD delivery.
